: My wife moved out with our kid (one child) on Jan 2012. We are not divorced and we are not legally separated, we are not looking for a divorce and willing to work things and live together again latter.



I have been paying 25% of my income to her for child support, and buying her gifts and giving her cash money every here and there, around $75 a month + her health insurance + her car insurance + I pay for vacations hotels camping dinners buy her things and like that.

She reported to some government office that she has no income and based on that they give her food stamps.

How do I file for taxes this year? do I except to owe the IRS money because we are not living together? do I qualify for any tax return?

she refused to file taxes joint with me, she want every one to file his taxes.
So if I file MFS then I lose all the taxe returns and all of that, correct?

: You could file Married Filing Separately or Married Filing Jointly.
The fact is you are still married.
Owing the IRS has much more to do with your withholding than your marital status.

: You file MFS. Whether or not you owe depends on what was withheld and what you made.

: If she refuses to file jointly with you, you will have to file MFS with just yourself on it. You can ask for a signed form 8332, but she doesn't have to sign.

: Yes and big problems in your future life time MFS is NOT the best way to file when you are still married and living to together at the end of the tax year.
She left moved out in January 2012 RIGHT for this purpose so you will NOT Have any choice really as long as you are not living with each other in the same home since that time in your life.

Unless she's willing to file a joint return with you, then you file as married filing separately.

In any case, the child support and gifts and cash you're giving her, and other things you mention, are not deductible.

Unless you have changed your W-4, you will almost surely owe tax when you file.

And it's probably going to come back and bit you. Make her come clean now, so you don't owe penalties later.

: if she has no income to report on a 1040, there is no point to her filing a tax return, she has nothing to be refunded
she can sign the #8332 waiver to allow you to claim the child but it will be to both your benefits if she will file jointly with you
I don't know why she thinks each should file their own taxes, she has no income and there is no reason for her to file--she doesn't get anything for the child without income

: You must file MFS. In your situation, this is not optional.

You do not "lose all the taxe returns and all of that", if you file MFS.

You do lose the EIC and a few other very specific things, but not everything.

However, if you don't file MFS, then you can lose everything, plus have to pay a very big fine.
